Terms of Sale

The seller of products in the shop is Ewa Fink, operating as an unregistered business (działalność nierejestrowana) under art. 5 of the Polish Entrepreneurs' Law.

The author of the photography and calendar design is Bartosz Fink. The brand “Bartosz Fink Photography” identifies the brand and the creator. The party to the contract of sale is Ewa Fink.

Consumer - a natural person making a purchase for purposes outside their trade, business, or profession. Sole trader with consumer protection - a natural person concluding a contract connected with their business where it is not of a professional character for them. Order - an offer to buy the selected products on these terms.

We sell fine art prints, posters, and photographic calendars based on photography by Bartosz Fink. Product details, images, and prices are shown in the Shop.

Photographic calendars are printed after the order and payment are received, according to the ready-made design presented in the shop. The mere fact that a calendar is printed after the order is placed does not make it personalised and does not exclude the right of withdrawal.

Product prices are the final amounts payable by the customer. Delivery cost is shown separately before the order is placed. The order summary shows the full amount payable. We reserve the right to correct obvious errors and to limit availability.

Placing an order constitutes the customer's offer to buy the products. The contract of sale is concluded when the customer receives an email confirming that the order has been accepted for fulfilment. That message contains the seller's details, the order summary, and payment instructions. Confirmation that the order has been accepted is not confirmation that payment has been received.

By placing an order, the customer confirms that the data provided is correct and accepts these terms.

The following payment methods are available:

1. Bank transfer to Ewa Fink's account: 18 1140 2004 0000 3202 6402 9382.
2. BLIK transfer to phone: 793 915 781. Recipient: Ewa Fink.

The order number should be given in the transfer title. For a BLIK transfer to phone, include the order number if your banking app allows a title.

The customer chooses one payment method and pays the full order amount, covering the price of the products and delivery. Printing and fulfilment begin once full payment is received.

An invoice documenting the sale is issued by Ewa Fink in accordance with applicable law. The customer may request an invoice when placing the order or later, under the rules and deadlines set by law.

We ship orders ourselves using DPD or InPost. We will dispatch your order within 14 business days of receiving payment, unless a different timeframe was agreed or communicated for the order.

The stated timeframe concerns dispatch. Delivery time additionally depends on the carrier and destination; where possible, we provide tracking information.

The risk of loss of or damage to the goods passes to the consumer upon delivery. The customer is responsible for providing a correct and complete delivery address.

A consumer (and a sole trader with consumer protection) has the right to withdraw from the contract within 14 days without giving a reason. The period expires 14 days after the day on which the customer (or a third party designated by them) takes possession of the goods. A standard calendar printed after ordering is subject to the right of withdrawal.

To exercise the right of withdrawal, inform the seller clearly (e.g. by email to bartosz@bartoszfink.com or using the model form below). Return the goods to: ul. Ułańska 42/5, 52-213 Wrocław.

We will refund payment promptly and no later than 14 days from the day we receive the withdrawal statement. We may withhold the refund until we receive the goods or proof of their dispatch, whichever is earlier. We refund the price of the products and the delivery cost up to the cheapest standard delivery method offered in the shop. The direct cost of returning the goods is borne by the customer.

Returning the goods in their original packaging is not a condition for effective withdrawal. The customer is liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature and characteristics.

Model withdrawal form (complete and return only if you wish to withdraw):

The seller is liable to the consumer (and to a sole trader with consumer protection) for the conformity of the goods with the contract under the Consumer Rights Act. This liability covers, as a rule, a lack of conformity existing at the time of delivery and revealed within two years of that moment.

If the goods do not conform to the contract, the consumer may request repair or replacement. Where repair or replacement is impossible or would involve excessive costs, and in other cases provided by law, the consumer may make a declaration to reduce the price or to withdraw from the contract.

Please send complaints to bartosz@bartoszfink.com with your order details and a description of the problem. We will respond to a consumer complaint within 14 days of receiving it.

A consumer may use out-of-court methods of handling complaints and pursuing claims, in particular the help of the municipal or district consumer ombudsman, the regional Trade Inspection Authorities, and the permanent consumer arbitration courts operating at them. Information about these procedures is available, among others, on the pages of the Polish Office of Competition and Consumer Protection (uokik.gov.pl).

Using these procedures is voluntary and possible only with the consent of both parties to the dispute.

These terms are governed by Polish law. For consumers, mandatory consumer protection rules of their country of residence may also apply. Nothing in these terms limits or excludes consumer rights under mandatory law. We are not liable for delay or failure due to force majeure.

This version of the terms is in force from 8 October 2026 and applies to contracts concluded from that date. The version applicable to a given order is the one published at the time it was placed. The previous version is available on request at the email address below. The change of seller details applies only to new contracts and does not alter the details of orders already placed.
