Terms of Sale

1. Seller and contact

2. Definitions

Consumer - a natural person making a purchase for purposes outside their trade, business, or profession. Entrepreneur - a natural or legal person acting for professional or commercial purposes. Order - your commitment to buy the selected products on these terms.

3. Products

We sell fine art prints and related products (e.g. posters) based on photography by Bartosz Fink. Product details, images, and prices are shown in the Shop. We reserve the right to correct minor errors and to limit availability. Prices are as displayed at checkout (including or excluding tax as indicated); delivery costs are shown before you confirm the order.

4. Placing an order

You place an order by adding products to the cart and providing the data needed to fulfil it: your name, email address, shipping address, and - if you want a business invoice - your company name, tax ID (NIP), and invoice address. By submitting the order you confirm that the data provided is correct and that you accept these terms. After you place the order we will send an order confirmation to the email address you provide, and a payment link in a separate message (see section 5). A contract is formed when we accept your order (typically by sending that confirmation).

5. Payment

Payment is handled via the Useme platform (useme.com). After you place the order, you will receive a payment link in a separate email; you pay on the Useme website using the methods available there. The invoice for your order is issued by Useme. We do not process or store your payment card details. If payment is not completed, we may cancel the order and will inform you. Shipping cost is added as a separate line item.

6. Delivery and shipping

We ship orders ourselves using DPD or InPost. We will dispatch your order within 14 business days of receiving payment (unless a different timeframe is agreed or communicated). Delivery times depend on the carrier and destination; we will provide tracking information when available.

Risk of loss or damage to the goods passes to you upon delivery. You are responsible for providing a correct and complete shipping address; we are not liable for failed delivery due to incorrect details.

7. Right of withdrawal (consumers)

If you are a consumer in the EU/EEA, you have the right to withdraw from the contract within 14 days without giving a reason. The withdrawal period expires 14 days after the day you (or a third party you designate) receive the goods.

To exercise the right of withdrawal, you must inform us clearly (e.g. by email to bartosz@bartoszfink.com). You must then send the goods back without undue delay and in any event within 14 days of notifying us. You bear the direct cost of returning the goods. We will refund the price and standard delivery cost (excluding any extra cost for a delivery method you chose) without undue delay and in any event within 14 days of receiving the returned goods or proof of dispatch. We may withhold the refund until we have received the goods or that proof.

Goods should be returned in their original condition and packaging where reasonable. The right of withdrawal may not apply to goods made to your specifications or clearly personalised (unless we have agreed otherwise).

8. Complaints and warranty

If you are a consumer, statutory warranty and guarantee rights apply. If goods are defective or not as described, you may request repair, replacement, price reduction, or withdrawal from the contract, in accordance with applicable law. Please contact us at bartosz@bartoszfink.com with your order details and a description of the issue. We will respond within a reasonable time and propose a solution.

9. Out-of-court dispute resolution

If you are a consumer, you may use the European Commission’s online dispute resolution platform to resolve disputes: https://ec.europa.eu/consumers/odr. We are not obliged to participate in such procedures.

10. Liability and governing law

Our liability is limited to the extent permitted by applicable law. We are not liable for indirect or consequential loss, or for delay or failure due to force majeure (e.g. natural disasters, pandemics, strikes, war). These terms are governed by the law of Poland. For consumers, mandatory consumer protection rules of your country of residence may also apply. Any disputes shall be submitted to the courts having jurisdiction under Polish law, without prejudice to the consumer’s right to bring proceedings in the courts of their place of residence.
